Research On Fabricating And Deliberately Spreading False Terrorist Information Crime

The behavior of fabricating and deliberately spreading false terrorist information is akind of behaviors that disrupts the social order, especially in contemporary society. In recentyears, more and more false terrorist information has resulted some side effects on the normaloperation of flights.From this point of view, we should make a deeper study on the crime of fabricating anddeliberately spreading false information, which is not only has a theoretical significance butalso is really important to the judicial practice. Meanwhile, it is also crucial for the applicationof the criminal law in regards of the punishment of crime acts, for the maintanence of socialorder, for the safety of people’s lives and property.Through the discussion from the academic views about fabricating and deliberatelyspreading false information, and the provisions of the authority on relevant issues, this theauthor will study several controversial issues on fabricating and deliberately spreading falseterrorist information crime and put forward his own views. This article consists of six parts,namely: the introduction of the issues, the object of the crime, the behaviors of the crime, theresults of the crime, the boundaries of the crime with other similar crimes, at last,thelegislative, judicial suggestions as well.The first part is the introduction of the issues. The author will analyze the differences andsimilarities of the case and event combing with the judicial practice case and the similar socialevent, and put forward a few issues about the conviction and penalty of this crime.The second part is mainly concerned about the object of the crime. Through thediscussion of the three types of threat information, which includes explosion threat,biochemical threat and radiation threat, as well as the study of the academic point of views ofthe false terrorist information, the author will put forward the concept the judgment criteria onthe false terrorist information.The third part of the article is the discussion about the behaviors of “fabricating” and”deliberately spreading”. Combined with academic point of views about the two behaviors, theauthor put forward the views and insights of himself.The fourth part of the article will analyzes the detail of the case of “seriously disrupting social order” and “causing serious consequence”. After academic analysis of these twoquestions, and the references of the guiding case of the supreme people’s procuratorate, theauthor figure out the criterions on “seriously disrupting social order” and “causing seriousconsequences”.The section V discusses the boundaries of this crime among other similar crimes injudicial practice, which is about the Crime of Racketeering, the Crime of Put False DangerousSubstances, and the Crime of Fabricating and Disseminating Securities, Futures.The section VI is some suggestions about perfection of the legislations and judicialinterpretations on this crime. Including the correct definition of false terrorist information, thespecific provisions of serious disrupting social order and cause serious consequences, thecharge of the crime.
