On The Crime Of Fabricating And Deliberately Spreading False Terroristic Information

The crime of fabricating and spreading false terroristic information is a new offence inthe thirdly amended Criminal Law. Since it was ratified, the incidence of the crime hasbeen comparatively high among the terrorist crimes, and it has notably increased in recentyears. In this paper, the feature of false terroristic information is analyzed, and the criteriaof conviction are investigated by analyzing the objective element of the crime, which is‘seriously disrupting social order’. Besides, several types of crime which are easilyconfused with this crime are compared through interpretation of the latest judicialinterpretation and cases, to explore the problems on the application of law related to thiscrime, viz. the difference between this crime and Public Security Penalty, the sentencing ofthis crime, and issues of Civil Compensation. Finally, some suggestions are put forward tofurther improve our national law by referring to foreign legislation.
