The freedom of an assembly, a procession and demonstration, as a general freedom ofexpression, is one of the most basic civil rights. It occupies important position in today’ssocial life and enlarges the space for people to express their opinions vastly. It’s conducive tosocial stability. It also improves national democracy. Constitution confirms citizens’ freedomof assembly, procession and demonstration. In real life, however, citizens’ exercising of suchright is not optimistic. This kind of right doesn’t reflect its value of due.The article which is introduced by case states the hazard of frequent group expressionbehavior, while safeguarding the freedom of an assembly, a procession and demonstration isan important channel to solve frequent group expression behavior. The government toleratescitizens’ assembly, procession and demonstration to some extent. And this offers the people alawful way to express their dissatisfaction and eases the social invisible crisis brought bypublic opinion not free in certain degree. It also has a positive significance on maintainingsocial stability.This paper is divided into four parts. The first part states an overview of the freedomincluding its conception, intension and function. The second part contains the stipulationsabout the freedom of an assembly, a procession and demonstration of China and foreigncountries and the comparison and analysis over it. It mainly states the stipulations about thefreedom of an assembly, a procession and demonstration of China and foreign countries andits exercising. We can find the shortage of the stipulations about the freedom of an assembly, aprocession and demonstration in China by comparing and analyzing.The third part states thelimits of the freedom of an assembly, a procession and demonstration. This chapter mainlydiscusses the necessity of restrict and the principles to abide by in restricting this kind offreedom. The fourth part is about the guarantee of exercising the freedom of an assembly, aprocession and demonstration; I put forward some suggestion and assumption to safeguard theexercising of citizens’ freedom of an assembly, a procession and demonstration from theaspects of legislation, administration and justice.
