On Reasonable Regulation Of The Freedom Of An Assembly, A Procession And Demonstration In Our Country

The freedom of an assembly,a procession and demonstration belongs to fundamentalrights of citizens,which is a special form of the freedom of speech.However,the freedom ofan assembly,a procession and demonstration is seen as a disaster in practice,and is ignoredin the theoretical reaearch.Coupled with the deviation about the right attribute,which leadsthe freedom don’t refect its value.In recent years,frequent group expression behavior upgraded to group eventsrepeatedly,a well constitutional assembly rights is in constitutional but illegal situation,so,itis very necessary to do the theoretical research.Our constitution confirms citizens’sfreedom of assembly,but given the particularity and complexity of the process of thefreedom exercise,at the risk of abusing and disrupting public order,regulating the freedombecomes necessary.Meanwhile,in order to prevent the goverment to abuse power,tosuppress acts of assembly,procession and demonstration by regulation,againstdemocary,limiting the government’s right is necessary and important.Aiming at China’s"Assemblies,Processions and Demonstrations Law" has strict regulation,the governmentmaybe abuse the power.After the preliminary discussion of the necessity and principles ofthe general theory,on the concept,methods,contents and relief of our assembly,processionand demonstration regulation.I puts forwards some reasonale suggestions,looking forwardto better implementation of citizen’s assemly,procession and demonstration liberty.
