Initial Exploration Of Zhang Youyu’s Human Rights Thought During The Period Of The Republic Of China

The second session of the Tenth National People’s Congress passed by the amendments to the constitution, and for the first time the concept of "human rights" was introduced to the constitution; it gives a clear definition of respecting and protecting human rights. This is an important milepost of the phylogeny of Chinese human rights. However, everything of course will not produce out of thin air; the development of Chinese human rights has its own indispensable history. Collin Wood once said that all history is the history of thought; he provides a dimension of historical understanding. During the republican period, human rights is the core concept of ideological circle, the scenes are blossoming freely, a lot of great masters have been explored the human rights problems, and Mr. Zhang Youyu is one of them. This paper will investigate the human rights thought of Mr. Zhang Youyu in the view of the history of human rights thought in the republic period. Human rights thought was governed by the human rights, and it discussed the importance and measures of the protection of human rights from three aspects, namely democracy, the rule of law and constitutionalism. These measures have certain reference value for the construction of human rights today.This paper consists of introduction, text and epilogue three parts.In the introduction part, it briefly introduces Mr. Zhang Youyu’s individual situation, illustrates the current research state of Zhang Youyu’s human rights thought, the significance of the selected topic, as well as the ideas and methods of the thesis research.The text can be divided into four parts. The first part introduced the origin of Mr Zhang Youyu’s human rights thought from the historical background and thought foundation the two aspects. In the second part, it mainly introduced the content of the human rights thought. Firstly, it expatiated the basic knowledge of human rights, and then discussed the basic content of Mr. Zhang Youyu’s human rights thought. In the third part, it mainly introduced the advocates of some security measures of the human rights of Zhang Youyu in the republic period. This paper interprets it from three levels. Firstly is constitutionalism and human rights protection. Secondly is democracy and human rights protection. Lastly is the rule of law and the protection of human rights from constitutionalism, democracy and the rule of law the three aspects, this paper basically presents its comprehensiveness and effectiveness of the human rights protection means. In the fourth part, the thesis mainly comments on Mr. Zhang Youyu’s human rights thought from the two aspects of human rights thought characteristic and the contemporary value. The main features of Zhang Youyu’s human rights thought contains the realistic political and the particularity of human rights subject the two main aspects. The current value of Zhang Youyu’s human rights thought is mainly emphasis on freedom of speech on human rights and the reflection of human rights instrumentalism.The conclusion part makes a brief summary on the human rights thought of Zhang Youyu in the republic period, and it gives the affirmation of its historical value.
