Sun yat-sen was the great pioneer of Chinese democratic revolution, in his revolution inthe hustle and bustle of life in China, also in constant exploration and summary in accordancewith the situation of China democratic construction theory, the civil rights thought is hisunique creation of Chinese democracy construction. Sun yat-sen system of the civil rightsthought connotation is rich, full, unique.This paper is divided into four parts altogether for interpretation and research of sunyat-sen’s thinking on civil rights theory:The first part, the five rights in the civil rights thought the constitution, the power todistinguish the theory, the concept of freedom and equality, combing the connotation of thecivil rights thought and logic structure. Civil rights thought the main expression of sun yat-senin the building of the democratic republic of the political thinking and exploration, whichmight distinguish theory stresses that the main body has a "right" to "people", the governmenthas the "can", the right to control the state power, to be responsible for the governance of thecountry, the right checks and balances to; Five-power constitution mainly discusses with theauthority of the government "to" is divided, which is divided into five powers;"People" andthe concept of freedom and equality to explore this subject, as a single individual can’t be toofree, and is made up of people of country is the absolute freedom, equality, is the pursuit ofequality of political status. Through the discussion of total score logic level, the civil rightsthought that people is the base of the democratic republic of the people is not a single people,but to have a group organized the people, and people are equal in the political status, countriesenjoy the absolute freedom.The second part and the third part, on the basis of the first part, can be divided intomacro and micro two aspects, analyzes the essence of the civil rights doctrine, it is concludedthat sun yat-sen’s thought of civil rights in essence is a kind of people-oriented thoughts, andthe external form is in the pursuit of a kind of democratic model. Civil rights thought tobinary separation of the people and the government, and residences in government is thehighest, hope that the people control the regime, the government just can have the server, inessence is a kind of traditional people-based thought. External form, expressed the people democratic participation as well as the fundamental position of the country’s politicalactivities.The fourth part, on the basis of former three parts, made a brief comment on sunyat-sen’s thought of civil rights, on the one hand, certainly this thought profoundly andingenuity of the theory of value; For the idea, on the other hand, disadvantages are reviewed.Civil rights expression way is the way of people with "open house" to establish a legaldemocratic government, and only as a way to express the civil rights of all people, and peoplecannot be too free, enjoy only the equality of political status, not individual freedom, equality,this suggests that the core essence of civil rights thought is the pursuit of a strong centralgovernment.Through these studies, summarize and review the previous wins and losses that hope canbring guidance to the construction of a democratic society today.
