Study On Nature Of Public Housing Lease Contract

From “the case of the housing lease contract’s dispute betweenAdministration of Chongqing Public Rental Housing and Mr Hu”, thethesis mainly adopting the form of case analysis report educes the focusof legal disputes which the case involved and carries on legal analysis anddiscussion on it through introducing the basic situation of the case. Basedon analysing the controversial focus of this case, it puts forward thespecific response on the case, at the same time it points out that the natureof the public housing lease contract and presents rational proposal toestablish the nature of public housing lease contract.This thesis is dividedinto three parts:The first part mainly introduces the basic situation and controversialfocus of the case.This part which mainly focuses on illustrating the claimsof the case and the fact related to controversial focus in detail sums up thecontroversial focuses of three aspects combined with the acceptance ofthe case, the plaintiff’s claims and the defendant’s defence, etc..The second part analyses the legal issues arising out of thecontroversial focus of this case. Analysing the controversial focus of thiscase mainly from three questions that the nature of the case which closelyrelates to the nature of the public housing lease contract,the effectiveness of the behavior to terminate the contract by housing administrationunilaterally, and whether the plaintiff’s subject qualification of the case iseligible.The third part comes to the conclusion of this case that the publichousing lease contract is an administrative contract, and from thelegislative and judicial aspects it puts forward some Suggestions onestablishing the nature of the public housing lease contract,which areactually the solutions to the case.
