On Apology As Civil Liability

Apology belongs to moral issue, in daily life, it has the effect of settling disputes. InChinese civil law system, apology is one of non-monetary liabilities, which has both legal andmoral attributes. Even lots of discussions relate to it, it still has the positive effects for victims.This article is about to dissertate how to establish a system which could exert soundly thefunction of apology.The article contains following sections:Part one refers to the regulations relate to apology abroad. These regulations includingbut not limited to statue law. Among them only China takes apology as a form of civilliability.Part two refers to the basic functions of apology from three different point of views:from the victim’s point of view, apology compensate the victim psychologically；help thevictim return to daily social life; establish social rules and educate the social members.Part three refer to trend that apology becomes a soft punitive compensation, how it fulfillits function and how multiple forms of liabilities could complete the methods deal with tort.Part four refer to the primitive state of apology in civil law, and possible extension of theexertion of apology which could help settle the disputes of different kinds of legal disputes.
