Research On The Enforcement Of Apology Civil Liability

Although apology in 2009 has become a clear responsibility of tort liability law,but how to implement apology has been a difficult problem in judicial practice.The victim was able to execute but not execute,and the victim still had nothing to do with the court's judgment.In our country,there are very few regulations on compulsory enforcement of apology.Courts at all levels can only take various alternative execution methods to remedy this defect,which leads to the debate of whether the compulsory enforcement of compensatory ceremony can be carried out by scholars.Therefore,the author tries to do a little bit of apology enforcement from the following three parts From the analysis,the author tries to provide some basis for the correct application of compulsory apology in the judicial practice of our country.The first part,an overview of the enforcement of apology.Firstly,it discusses the connotation of compulsory execution of apology,including the concept and characteristics of compulsory execution of apology,and the scope of application of compulsory execution of apology.The second is the historical development of the compulsory execution of apology,the development of compulsory enforcement of apology in our country and the development of compulsory enforcement of apology in our country in foreign countries.Finally,the significance of compulsory enforcement of apology,including theoretical and practical significance,is expounded.The second part,the current situation and existing problems of compulsory enforcement of apology in our country.The first is to enumerate the relevant provisions of the legislation on the enforcement of apology,and analyze the problems behind the legislation.The second is to explain several models of compulsory enforcement of apology in judicial practice,and analyze their advantages and disadvantages,find out the reasons for the difficulty.The third part,our country apology enforcement perfect suggestion.Through the analysis of the above two parts,this paper puts forward some reasonable suggestions on how to enforce the apology.
