Farmers’ professional cooperatives a competition economicorganization, it is in a weak position of farmers in the competitivemarket conditions, the voluntary union of the product. It produces on thebasis of household contract. Union members are out to provide the samekind of product or service, in order to increase revenue, reduce costs,and the establishment of democratic governance, equality organizations.Such a farmer cooperatives with other economic entities incomparableadvantages, for example, offers low prices of agricultural seeds, theuse of cooperatives can provide synergies in the use of farm equipmentwhen needed, can get more information on agriculture, learning to improveproductivity relevant technical knowledge. Countries in order toencourage the establishment and development of farmer cooperatives,farmer cooperatives established back loans, tax incentives proposedtransaction and so on. In this context, Chinese farmer cooperativesmushrooming development. And it is in this context," FarmerCooperatives Act "(referred to as "agricultural legitimate")promulgated and implemented, which is certainly the dominant positionof the farmers market members to provide a legal basis. Law for membersof the relevant content rights, obligations, cooperatives. As aprofessional cooperative development program of legal documents guidingthe farmers, the introduction of the law on cooperatives do have somerole in promoting development. However, the distance of the law has beenenacted over past eight years, the content of the law can not meet thepractical problems faced by today’s cooperatives. Especially theprovisions on the rights of members of cooperatives, there are manyimperfect parts. Urgent need to amend the law in the future on these issues to be modified. Therefore, the author studies the rights of members offarmer cooperatives, excellent contrast to the provisions of foreign law,trying to find in the future to amend the law can provide a theoreticalbasis for reference. I hope the rights of members of farmer cooperativeshas been improved, so that the members are willing to actively participatein the affairs of the cooperative and actively promote the developmentof cooperatives, it can quickly become powerful in the marketcompetition。This thesis contents four parts.The first part covers a detailedaccount based on the research of member’s background and domesticcondition。The second part does a research into the rationale of member’s rights through the comparison and document-analysis, which includes theconcept, quality, characteristic, and content of the member’s right. Asfor the third part, it does a comparison and study about the gain, loss,implementation and relief of the member’s right in the foundation ofChina’s Professional Farmers Cooperatives Law alongside the theory andconstitution from foreign countries. And it is found that foreignlegislation has its unique advantage which can be learnt to perfectChinese own legislation.The last part, according to the merits of foreignlegislation and system, gives an account of the method to improve theChinese Professional Farmers Cooperatives Law in accordance with thecondition of our country.
