A Study On The Legal Issues Of Rural Land Trust Property

In the rural land trust system, rural land trust property is the core of the whole system. When using commercial trust to promote efficient circulation of land rights, property right theory is how to integrate reasonably. What is the scope of trust property as the land trust property object of legal relationship? Is there any development difficulty in theoretical and practical process of rural land trust? Which kind of route should be select to overcome difficulties? Could it build perfect system of rural land trust property?According to the above problems, this article will demonstrate as follows:the first part which is starting from the concept and connotation of trust property, indicates its special legal character and summarizes the right of the circulation of trust property. Then, the basic problem of trust property will be demonstrated and lay a foundation for later discussion. Secondly, related policies, laws and regulations of rural land trust will be combed. Combining with the current land trust practice, there exist some development difficulties of land trust property, such as single type, unvalued independence and defective display system. Thirdly, the value orientation should be unified of efficiency and fairness in order to overcome the difficulties. Guided by the value orientation, the route is selected and its feasibility will be argued. Finally, based on the above discussion, the author attempts to construct the rural land trust property system.
