| When the workers fall ill, their labor capacity usually lose temporarily, and the directly influence is the laborers’income decline or even lost. Therefore, all countries make laws to guarantee the workers’ income to be in an average level who are in medical treatment period.In our country,we have built the medical treatment worker income security system by some laws such as "Labor Law","Labor Contract Law "and "Rules of Medical Treatment Period".It manifest as sick pay, dismissal protection and sickness benefit.However,the system has created many problems.The more common is that the workers can’t get sick pay or be fired in their medical treatment period,so the system can’t guarantee the labors’income.In this paper,we compare our country’s system to the Taiwan and German’s similar system to imitate their merit.The purpose is to perfect our medical treatment worker income security system.The first part of this paper lead to the current medical treatment worker income security system in China through three cases including three main institutions:sick pay,dismissal protection and sickness benefit.And it put forward that the three existing systems in China is still insufficient in practice.The second part analyze the operation pattern of medical treatment worker income security system in our country according to some laws and rules.The third part analyse the medical treatment worker income security system in Taiwan and Germany and compare it to the mainland’s to conclude our system’s specific defects.The last part put forward some advice about the sick pay system,dismissal protection system and sickness benefit system,so that,our medical treatment worker income security system will be improved.This article’s innovation point lies in that the concept of medical treatment worker income security system is proposed.At the same time,the paper discusses the medical treatment worker income security system based on the explanation theory rather than the legislation point of view. |
