Currently, third-party payment has become an important part of the social payment system. But the existence of the legal risks of third-party payment platform has become even more prominent, such as the legal subject status is not clear, customer’s provision for interest attributable to the lack of clarity. This paper analyzes the full measure of the current third-party payment platform and its legal regulation shortcomings, combined with previous research results, to be explored and research on related issues, obtain a third-party payment platform for China to carry out legal regulation proposals. This thesis includes the following parts: the first part of the development of third-party payment platforms are introduced, from a legal perspective analysis of the third-party payment platform features and content. the second part, a brief analysis of the third-party payment platform for US and European legal regulations for the country to improve the relevant laws and regulations for reference. the third part of the relevant laws and regulations of China’s third-party payments to be elaborated in the analysis of this issue, from the two levels, which are related to the problem of domestic legislation in this field as well as the existence of a detailed analysis of the third-party payment legal Status in the legal regulation of the level of uncertainty exists, the Consumer Protection unfavorable provision for interest attributable to customer confusion, financial crime, regulatory mechanisms are inadequate and other issues. Meanwhile comparison of America and European regulatory payments to third-party platforms, draw a third-party payment platform to improve our legal regulation to start. Based on the above discussion of the various parts of the fourth part of the third party on how to improve the building regulation, consumer protection, improve customer and interest on excess reserves system and the fight against financial crime and other aspects of legal regulation of payment platform proposed.
