As the rapid development of information technology, people’s way of life ischanging gradually.The wide application of e-commerce has brought the vigorousdevelopment of the third party electronic payment. As a new type of payment, the thirdparty electronic payment to some extent, solved the problems of online paymentsecurity and credit in e-commerce, greatly promoted the rapid development ofelectronic commerce. But, contrary to the vigorous development of the third-partypayment industry is the lag of law, In2010,the People’s Bank of China publishedMeasures on Regulation of payment services of non-financial institution,which is thefirst legislation to regulate the third party payment.However it is only a regulationfrom the aspect of public law, there are still some legal issues that not solved. Such asthe third-party payment institution is not clear,the legal relationship choas,consumerprotection, etc. Series of problems posed a challenge to the legal system in China: howto guarantee the rights and interests of the parties? how to applicate laws in the courseof legal proceedings? If the problem is not solved, it will not only hinder the healthydevelopment of the third-party payment industry, but also a cause of financial risk.Therefore, we must clarify the parties rights and obligations and legal responsibilities,which need us thinking more in-depth abaut the legal issues involved.in order to have a relatively objective and comprehensive understanding,I willdefine the third-party payment institutions firstly, classifying its payment mode,through the comparison of different payment modes analysis more clear understandingto the third party payment, and then leads to the third party payment in some of the problems existing in the development of industry. It’s important to establish the legalstatus of third-party payment and clear the rights and obligations in the relationshipamong various participants. So the second part of the article mainly discusses about theissue, through the above analysis and research, hope to contribute to the perfection oflegal system of the third-party payment, promote the healthy and orderly developmentof the third-party payment industry.
