Legal Protection Of Smart Phone Users’ Rights To Dispose Pre-Set Applications

With the rapid growth of networks technology in the early21st century, the smart terminals have brought us much brand new experience and magnificently changed our lives. They are now the indispensible part of our daily lives. Among the smart terminals, smart phones own the largest number of functions and users due to their plenty of applications. However, together with the convenience, the smart phones and applications also bring us problems, mainly the infeasibility of removal of the pre-set applications. Some of these pre-set applications even steal the private information of the users or secretly grow the phone bill, which violate the rights and interests of the users.The thesis analyzes the causes and the acts of tort of pre-set applications by summarizing and sorting the technical principles and cases of tort of smart phone pre-set applications. Meanwhile, the thesis also affirms the user’s right to dispose pre-set applications based on Contract Law and Tort Liability Law. What’s more, the thesis studies the related laws abroad, investigates the legal status and problems at home, and puts forward the legislative suggestions and retailed measures to protect the disposal rights of the phone users.
