As one of the earliest country in the world who has established patent system, France has a patent system for more than three hundred years. In the process of three hundred years of development, the French patent system has experienced a long and full development in all aspect. While The history of the patent law in our country, by contrast, are much shorter. Although the patent law in our country lasts for several decades. But comparing with the french patent law, we still have quite a lot to learn. Thus learning the successful experience from the developed country is an effective way to develop our own patent system. On the other hand,while we are learning from the advanced country, we still need to pay attention to the difference between France and China. Other than any other reasons, the difference between the two country is the real reason that results the difference in their legal system.This essay will discuss the difference between the patent system of China and France by comparing the patent law of the two country. The French patent law has several merit which we should learn.
