Justice must be seen by people to be done. During the operation of law, the substance justice and the procedural justice are indispensable. Procedural justice is to ensure the substantive justice. In recent years, civil servants recruitment in China has been brought into focus. As the implementation of the "Civil Service Law", the civil service examination is becoming standardized, but there are still some problems about its relief program.The first part is "The suability of civil servants ".First, to discuss the nature of the civil servants recruitment. Secondly, to discuss if the civil servants recruitment belong to the scope of the administrative litigation, based on the nature of the behavior of civil servants recruited.The second part is "The jurisdiction of the court and some related questions". First, to introduce the jurisdiction of the court about the civil servants recruitment cases. Secondly, point out some problems related to it.The third part is "The defendant problem of the civil recruitment cases". Mainly to analyze the proper defendant problem of the civil recruitment cases by the case of Liu Jiahai in Guangxi. And to investigate what circumstances the recruiting agencies and civil authorities were under should be the defendant.The forth part is "How the court to ensure the legitimate rights of the plaintiff in the litigation stage". This part puts forward the basic thought of how the court to ensure the legitimate rights of the parties in the litigation stage. First, freeze the job hiring work during the proceedings. Secondly, sentence the defendant re-make an administrative behavior. Again, sentence the defendant take remedial measures. Last, judgment the defendant to public examination content, answers and scoring criteria.
