Emperor Guangxu’s reign of the Qing dynasty is a special dynasty during thatperiod,with the foreign powers’ aggression and the Qing government retreat step bystep leads to people of all ranks and classes in China began to awake, Westernization,reformers, revolutionaries started to have a reflection and change on Chinese legalsystem in varying degrees.It can be said that under the western powers’ persecutionand Chinese people’s efforts,China ’s legal system began to modernize.However, thepaper notes that the fact that the entire dynasty of Emperor Guangxu’s reign waspuzzled by the frequent and severe natural disasters, while the refugee issue caused bythe relief problem exacerbated the social crisis of the Emperor Guangxu’s reign. Insuch a crisis, with the failure of the legal system of traditional disaster relief,thenon-government relief system in society came into being and stepped intomodernization by transferring from the traditional form of relief to the form ofcooperation between the government and the people.This paper clearly demonstratedthe legal modernization process by combing through it. Meanwhile, this paperattempts to explain the issue of refugee is an important factor in promoting themodernization of the legal system of Emperor Guangxu’s reign.This paper is divided into an introduction, body and conclusion of three parts.The introduction mainly describes the purpose and significance of the study andliterature review. The body is divided into three chapters.The first chapter focuses on naturaldisasters and refugee situations in Emperor Guangxu’s reign and the Qing dynasty.In Chinese history, Qing is a natural disaster-prone dynasty, while EmperorGuangxu’s reign is worse than the Qing Dynasty in the past.This chapter shows a panorama of the natural disasters in Emperor Guangxu’sreign by describing the frequency, breadth and strength of the natural disasters.Meanwhile it elaborate s the refugee problems caused by natural disasters.The second chapter focuses on the traditional relief legal system. From theperspective of prevention and control of refugee the paper re-sort the traditional legalsystem. By re-examination of the traditional relief legal system and comparing to theoperation of the legal system of the traditional disaster relief, the paper found thedrawbacks and shortcomings of the traditional relief legal system and explore thecause of its failure in Emperor Guangxu’s reign.The third chapter discusses the rise and the superiority of the non-governmentrelief system.While the Traditional disaster legal system has not worked duringEmperor Guangxu’s reign, the rise and the superiority of the non-government reliefsystem nicely complements it, thereby reducing the pressure in terms of disaster reliefand and alleviating the refugee issue.The conclusion mainly summarizes the impact of the modernity of thenon-government relief to the traditional disaster legal system and the entire Chinesetraditional legal system.
