On The Legal System Of Refugee Protection

In 2012,the Syrian war broke out,and the situation in the Middle East was turbulent.The local situation was out of control,resulting in a large number of refugees entering the European continent from the Middle East along the Mediterranean Sea.European countries were unable to sustain the huge refugee flow,and a serious refugee crisis broke out.With the continuous change of the international situation,the refugee problem is complex and many new situations appear.However,in the face of the refugee problem under the new situation,the current international refugee law has a large lag.The important conventions on the protection of refugee groups,the 1951 Convention on the status of refugees and the 1967 Protocol on the status of refugees,have limited application groups to "Convention refugees".At the same time,the protection of Refugee Rights is mostly a principle provision,which has a strong ambiguity.To some extent,the relevant rules of international law can not adapt to today’s refugee situation,which also restricts The development of domestic legal systems for refugee protection in various countries.For this unprecedented refugee crisis,this paper explores the following issues.First of all,there are some defects in the legal system of refugee asylum in the EU,and the responsibilities of refugee screening and resettlement are not evenly distributed.According to the "Dublin system",the "first country of entry" is responsible for the identification of refugees before they enter the country,but this will inevitably cause the European border countries to be overburdened,and the uneven distribution of refugee responsibilities,which will make all parties shirk their responsibilities,resulting in a large number of refugees staying at the European border.The second problem is the inefficiency of refugee screening procedures and the disunity of screening standards.In the face of the influx of a large number of refugees,the traditional screening process takes a long time,causing refugees to stay in the "first country of entry" during the period of awaiting trial,which has a serious impact on local public security.Finally,this paper focuses on the Enlightenment of the European refugee crisis to China.China’s relevant laws on refugee protection are still blank,while the European Union has started the construction of refugee protection system since the 1970 s.China can learn from the European refugee protection system in combination with its national conditions,and form a refugee protection system with Chinese characteristics from the definition of refugees,refugee screening and anti-terrorism,refugee resettlement and other aspects.
