In the context of the development of market-oriented economy, effectively taking place in the era of our country, more and more real estate developers gradually turn from the residential property to the commercial property which is aiming at merchandising. Be different from the residential property,the commercial property has relatively a large floor space thought it is not very closely related to people’s life, as for not in the purpose of reside, the large increasing number and scale of it can’t be ignored.However, at present the study of building ownership still stays on the specification of residential property, non-residential property, especially the occupies a large proportion of retail properties, didn’t get the due attention it deserves. The commercial properties contain complicated legal relationship, but in terms of legislation and practice operation, they are facing many problems. Due to the essence of business community, commercial property owners and residential property owners haver different interests, the tenants of the commercial property not only need to apply the contract law to protect their legal rights more in need of the property law as owners or occupants who would be entitled the exclusive, absolute rights. And the current legislation in this area is evidently blank or ill-conceived of protect. In the property management statute, for example, the adjustment of the formats and the cost of property adjustment and the procedure of convention, there still are many problems to work on.Such as the right for owners volunteered to set up the committee of tenants association, exercising member right, the decision-making process and the limitation on the owners’ right to vote, as well as how to provide resolution from the procedural law, are very important and significant issues.
