Probation is a system of minor criminal offenders qualified suspending declaration orexecution of punishment, which was created in the middle of19century. It is a reaction ofindependent punitive law with humanism, individualization and socialization, and it fits theprogressive tendency of modern law civilization..Probations spread quickly after its emergence. Since it shows the value of punish lawwith justice, order and freedom. At the end of the19th century, the major legal states areembracing the system of probationary suspension. Our county’s system of probationarysuspension concerned in the related law of government of the late Qing and the Republic ofChina in historical evolution. After the founding of New China, our country’s probation hasmade headway in theory and practice, but it has room for improvement both in legislative andthe judiciary practice compared with the developed legal states in the world.The article is a result of analyzing acceptable conditions of system of probationarysuspension in the last five years of Tongliang County, Chongqing City and summarizing theproblems accrued in the process of probation execution in the people’s court at the basic levelof Western County based on it, then put forward some new ideas to perfect the system ofprobationary suspension in substantive law and adjective law dimensions.The first part, applicable to TongLiang nearly five years of probation data analysis, sumup out the county probation for the judicial practice basic situation and characteristics.The second part is summarize of the basic situation and feature of the county’s probationexerted in juridical practice after analyzing the data of the whole and some individual criminalcases of Tongliang county in the last five years.The third part is a summary of the defects our county’s probation acceptable status basedon the study of the basic situation and feature of the county’s system of probationarysuspension.The last part is putting forward some new ideas to perfect the system of probationarysuspension in substantive law and adjective law dimensions based on the present status of theTongliang county’s acceptable condition studied in above paragraphs...
