| Yunnan province is Located in China’s southwest, bordering Burma, Vietnam, Laos, where is a distribution center of foreign drugs into our country, but also the important position of the anti drug struggle. J county is located in the southwest of Yunnan Province, is the Dai, Yi Autonomous national multi Minority Autonomous County. in the eyes of the drug criminals, the is a major drug trafficking channel--323state line road running through its territory and being connected with "Golden Triangle", because of the special geographical position, the county has become one of transit the overseas drug permeate in our country, long suffering from the crossing drugs. In this paper, taking J County of Yunnan Province in anti drug work perspective, through access to the files materials of2007to2012, interview and other forms, for investigation of the basic situation of the county drug crimes, to analysis the reasons of the drug crimes and explore the measures to against drug crime. This article about twenty thousand words, is divided into four parts.The first part starts from the concept of drugs and drug crimes, the development of the drugs, to briefly introduce the harm of the drugs to individual, families and the society as well as the problems of drug crime in our country. In this section, the "drug crime" of criminal law is limited to Chapter VII of the12offenses listed, which is ruled out, such as robbery, theft of drugs and other drugs derived from crime.The second part combined the judicial practice of J County, Yunnan Province, analyzed the profile of the county’s drug-related crimes, including drug-related criminal cases J county characteristics and the overall status of the county’s judicial practice handling drug crime problems and confusion. First, J County drug crime type mainly for transporting drugs, multiplayer gang crime in the form of common drugs involved mostly with methyl amphetamines; farmers and unemployed young adults are the main force of drug-related crimes, and the overall level of education partial low, these people are mostly engaged in drug-related crime by employment, crime is relatively simple manner. Secondly, J County judiciary in handling drug cases are not involved in drug content emphasis on the identification of crime patterns to determine, the application of technical investigative measures, transport behavior and illegal possession of a lack of distinction between the behavior of relatively uniform workable standards, dealing with drug offenses from the criminal point is higher, a larger proportion of the death penalty applies. In this section, the author on these issues put forward their own point of view.The third part of the combination situation and characteristics of J County and analyzed the causes of J County Drug Crimes. Summed up in the following seven reasons:First, geopolitical factors; Second, legislative factors; Third, the special nature of the case and the investigators of their own reasons; fourth, domestic drug market is a huge temptation of high profits; Fifth, foreign personnel mismanagement; sixth, socio-economic development is lagging behind; seventh, are residents of low levels of education, a sense of law.The fourth part based on the status and causes of the drug crimes in J county, this paper proposes measures to curb the county’s drug-related crime. The author believes that the solution about J County drug crime problem, from the following seven aspects:First, cut off the source of drugs to prevent the penetration of the drug to the territory; Second, improve the legislative and judicial interpretation; Third, to strengthen judicial personnel capacity building, awareness case quality; Fourth, strict control of drug addicts, reduced domestic demand for drugs, compress drug market; Fifth, strengthen management of foreign workers registered; Sixth, the development of regional economy, led border poverty; Seventh, strengthen anti-drug publicity and education enhance public legal awareness. |
