Studies On The Law System Of Maximum Amount Guarantee

Economic development is becoming more and more mature. To satisfy the needof continuous transactions, the maximum amount guarantee is the guarantee assumedby the guarantor with fixed maximum amount agreed by the creditor and theguarantor for debt incurred between the creditor and debtor in a certain continuousperiod.This paper starts from the introduction of the history of maximum amountguarantee, then analyses maximum amount guarantee in the following areas: thedefinition and characters, values and defects, the boundary, alteration and limitation ofguaranty credit rights. And based on these analysis, this paper finally proposes somesuggestions on improving the maximum amount guarantee system.The whole thesis consists of three parts, apart from foreword and conclusion.The first chapter is about to the introduction of the maximum amount guarantee.This paper introduces the maximum amount guarantee in other jurisdictions andcomparative analysis of maximum amount guarantee. The maximum amountguarantee shares many similarities with the general guarantee and mortgage, but alsohas many differences.The second chapter is about the application, determination and settlement ofmaximum amount guarantee. The chapter mainly discusses the application of the maximum guarantee and the scope of guarantee. The chapter mainly discusses theprovisions of maximum amount guarantee on guarantee period.The third chapter analyzes the problems existing in the prevailing system themaximum amount in our country. This section is also on the perfection of themaximum amount guarantee.
