To Investigate The News Supervision In Defamation Crime And Non Crime

In recent years, because of the news supervision of public opinion to the pressdefamation event more and more, the relationship between news supervision of publicopinion and the press defamation has become a hot point and focus increasingly inpress circles and the legal circles. At present in our country, the news supervision ofpublic opinion is not legal support and strong, no criteria fordetermining the absolutenews supervision of public opinion in the libel. In this paper, based on the researchresults of predecessors, combined with newsslander incident situation and the judicialpractice problems encountered in the process, in-depth analysis of the relationshipbetween China’s news supervision of public opinion and the citizen’s right ofreputation and the supervision by public opinion of news appeared in the newsbecause of slander incident, is due to the right of public opinion the supervision andprotection of reputation rights of both cross and conflict, is currently the loopholes inthe law and not perfect; analyzes the criteria for our news libel, different interpretationof the news libel and other crimes, from the objective and subjective aspects definesthe press defamationcrime and non crime; finally, from a legal point of view putforward several suggestions of the news supervision of public opinion. In the aspectof legislation,law enforcement and procedure is proposed for a series of reflection thenews supervision of public opinion of the rule of law, accelerate the news relatedlaws,establish a legal protection mechanism effectively, strengthen the constructionofprogram in the supervision of public opinion, strengthen law enforcement,establishthe news supervision of public opinion and the judicial independence of the benigninteraction. Aimed at the news libel judgment standard, provide a useful reference topromote the legalization of supervision by public opinion of news.
