Reflection Of The Marital Property System

Now our country’s marital property system is commmon system,it conforms to our history tradition and marriage custom,but the marriage law explain three has destroyed our country "marriage law" legislative purpose and spirit,it began to close to the respective property.it aroused the social and academic circles a lot of controversy. On the other hand,it has exposed our country "marriage law" has some shortcomings. so i do some exploration to improve our marital property system, meanwhile adhere to commmon system.This paper is divided into four. The first chapter is an overview of the marital property system.it has expound the basic principles of marital property system and functions; The second chapter has introduced the legislation of Anglo-American law system and continental law system. Summed up the legislative trend of the world is commmon system; In the third chapter i have make some analysis of our current marital property system and summary the defects; The fourth chapter is some ideas of perfecting our country’s marital property system.
