Studies On Legal Problems Of Trade In Services Of CAFTA

Building a vigorous or fresh Free trade zone with ASEAN can provide a steady and widened market for development of China’s economy; in the mean time it also can produce a good political mutual trust environment for China’s peaceful rise. The Service Trade Agreement of CAFTA signed by China and the ten countries of ASEAN is the first service trade law signed between China and foreign countries. The development of services Trade has been an important factor which affects economic development of different countries. But as a new developed industry, there are many factors affecting the service trade, such as the management system of service trade is not smooth, and the relevant laws and regulations is not complete, poverty in the knowledge and handling of the development of international services trade and the international services trade market.The first part of this paper is the literature review, which mainly concerns about the development of research in CAFTA and its services trade in home and abroad The second part is about the definition and format of services trade, and the current situation and development of the global service trade. And then focus on analysis the current situation of CAFTA services trade, the separated current situation and development of China and the ten countries of ASEAN. Including the volume of service trade and the analysis of the trend of development, with the analysis of trade structure, According to the data analysis, effective measures to boost are proposed.The third part discussed the present situation and the problems of CAFTA service trade legal system comprehensively, judged the multilateral legal system and the bilateral legal system of service trade and its domestic legal system. The former includes legal rules of service trade set by GATS and the multilateral legal rule and the bilateral legal rule of CAFTA service trade. Then give a summing up of various service trade legal systems in different angle of view.The fourth part presented the service trade legal systems of the three free trade zone.EU, CAFTA and ASEAN. The legal rules including cutting down the service trade barrier and resolving trade disputes. These discussing can provide the comparing and be used for reference.On the base of the former fourth parts, part five analyzed the frame and agreement of the CAFTA service trade law and relevant rules, and put forward suggestions to improve the bylaw. Proposes from three aspects were proposed including the service trade legal system of free trade zone and the domestic service trade legal system of China to perfect the legal bylaw. Then put forward some suggestion to perfect the service trade relevant rules from the economic aspect and administration aspect.
