Africa is one of the main overseas investment destinations of China. In recent years, the investment between China and Africa is booming. As the fastest-growing regions of economic development in Africa these years, West Africa has a huge attraction to the Chinese enterprises’investment.West Africa has a unique investment legal environment affected by various factors such as geography、history and culture. It is necessary for the Chinese enterprises to get familiar with the investment legal environment of West Africa. According to these possibly happening investment risks, Chinese enterprises should attach great importance to improve their adaptability to the environment, and take some measures to get the purpose of their investment to avoid and dissolve the risks.Based on the thought above, this thesis can be divided into the following three parts.Part one:Research on investment legal environment of Western Africa. The analysis on this issue starts from the practice of Chinese enterprises’ investment in Africa, including historical development and the corresponding tracks of each stage and the situation. Then specific analysis on Western Africa is what this part mainly talks about. This part focus on the study of investment legal documents and policies of West Africa, and several legal practices of West African countries are listed for the illustration. In addition, this part also points out the rules and regulations concerning the rights and profits of overseas investors. The analysis concentrate upon several aspects:the legislative purpose, the examination and approval procedures, preferential policies for the investors, the security guarantee for the investors and the provisions of special industries.Part two:Main legal risks in the process of Chinese enterprises’ investment to West Africa. Based on the study of the investment legal environment of West Africa in Part two, analysis several risks possibly appear in the process of investment:the excessive liberalization and ambiguity of investment legislation, the conflict between different rules, the lack of necessary guarantee for the stability of overseas investors, and the separation of legislation, enforcement and justice.Part three:Respond of Chinese enterprises to the risks. Some recommendations to Chinese enterprises are given. According to the risks mentioned in part three, the recommendations mainly include:improving political acuity, increasing technology investment, the implementation of the localization strategy, the enhancement of the emergency response capabilities and so on. The implementation of localization strategy is extremely significant.
