Research On Restraint Mechanism Of Internal Supervision Of Procuratorial Organs

This article mainly talks about the improvement and construction of internal supervisionmechanism of the procuratorial power. Firstly, we summarized the procuratorial power and the internalsupervision mechanism of procuratorial power and emphasised the necessity of the perfection andconstruction of internal supervision mechanism. Secondly, we studied the current sitution and problemsof internal supervision mechanism in four areas containing the subject, the object, the method and theeffect of internal supervision mechanism. Finally, we proposed improvement measures according to thereform options of the Supreme People’s Procuratorate on furtherance of the reform. The options includeimprovement of supervisition sense and internal structure of prosecutor, acceptance of supervision andstandardzing of internal institutions. And more importantly, it also includes optimization of supervisionsubject, improvement of investigative power, perfaction of arrest jurisdiction, refinement of suit powerand improvement of legal supervision power. It should be promoted to improve the punitive system ofinternal supervision, so we could guarantee the implementation of internal supervision mechanism.
