The consumer’s right of regret is the legal system has been widel y established in other countries in the world, in a foreign country h as a relatively long history and mature development, is a system tend s to protect consumers, aimed at balancing the disparity between cons umers and operators strong weak position to promote good and orderly development of the social economy. The consumer’s right of regret mea ns that after the conclusion of the contract, the consumer may be wit hin a certain period without justification to terminate the contract and return, but does not need to bear the liability for breach contra ct. The new " Law of the PRC on the Protection of the Rights and Int erests of Consumers" in our March15,2014the implementation of Arti cle25for the first time in the form of law established the consumer ’s right of regret in our country, which is the important initiatives to protect the legitimate rights of consumers and promote social eco nomic harmony development.Because the consumer’s right of regret in our country for the fir st time established, it is inevitable that deficiencies exist in the improvement and implementation of laws such as the law stipulates, fu ndamental research work has already embarked on academics, but there is still some controversy. In this paper, using literature study, emp irical study and experience summary, survey and other research method s, to find the consumer’s right of regret deficiencies in our country and put forward reasonable Suggestions.This paper summarizes the results of basic research to the consu mer’s right of regret, the provisions of consumer’s right of regret i n the" Law of the PRC on the Protection of the Rights and Interests of Consumers " as the center, pointed out our country present law has the following disadvantages, transaction model provides incomplete, goods NA the consumer’s right of regret is not unclear, exercise elem ents of the standard is not easy to grasp, subject to the provisions scheduled period to be perfect. In legal practice has he following di sadvantages, operators is insufficient to implement and difficult to safeguard the rights of consumers. This article summarizes the foreig n eventually the consumer’s right of regret legislative model, the ba sis of specific provisions of the advanced experience, China should i mprove and propose a method to the consumer’s right of regret to the legal practice of the two existing laws to promote the development an d maturation.
