The21st century is the age of the aging of the population. As China entered the aging society in1999, is one of the developing countries which enter into the aging society. China has the largest population in the world, so aging problems not only have an effect on China, but also the whole world. As the development of the aging population, our country’s old people should get wide assistance. So far, there is only little article has. mentioned the old people’s guardian problems, and the scope is limited, the content is meaningless, and the articles are scattered. In this way, it takes only little effect on the old people. The guardianship of German which has been revised that raise a lot of new ideas. And this system gives an useful experience to our country.The first part of the thesis analyzes our legal circumstances of the guardian of the old people. The guardian of the old people only being mentioned in the civil law and the old people’s rights guarantee law. But in these two laws, only has little content about old people.The second part of the thesis, mainly discuss the specific problems of the old people’s guardian in our country. Our guardianship now facing many issues, such as the legislative ideas are old fashioned, the missing of appointed guardianship, and so on.The third part of the thesis mainly introduces the content of German’s guardianship, and make conclusion on the useful experience that we can learn from it. German’s revised guardianship has many aspects that we can learn from them.The final part of the thesis mainly analyzes the establishment of our own guardianship of the old people. Our country should update the idea of the guardian, change the legal guardianship, and build the appointed guardianship.
