Mapping to the evidence field of procedural law, sinceamend civil procedure law in2012and Criminal Procedure Law in2013, electronicdata was separated from the type of audio-visual material evidence, and became thecorroboration of the law of procedure. It’s not hard to see thatinformatization development in China push the study of electronic data to a new era.The author believe, as the legal evidence to qualitative electronic data is just abeginning, The application of electronic data, social real effect and the legal effectwill be the research area of the new types of the evidence. This paper firstlyintroduces the comparison between the legislative mode of the case law system andthe legislative process in China, then have a preliminary study on the origin,development of the electronic data, and obtain that as a kind of evidence electronicdata show an Inexorable trend of horizontal development and vertical development.Then to make it clear that during The development of information society which isobstructing the electronic data evidence rule determination, through analysis theprocess of judicial practice problems to find what makes the electronic data havedeviation and Instable, and to find out the countermeasures, so that to solve thepractical problem of electronic data which have big difference, weakly stability andit cannot recover, we can according to the regulations give detailed comments.Inorder to achieve the correct identification of social law, to solve the dual effectof electronic data and deal with the problem of judicial practice.
