Perfection Of China’s Legal System Of Infectious Disease Prevention And Control

Infectious diseases are a serious threat to human health, and perfect legal systems are the guarantee of prevention, control and eliminate infectious diseases. The prevention, control, elimination of infectious diseases not only needs the support of science and technology, but also needs the protection of legal system. Laws on prevention and control of infectious diseases are the sum of the laws and regulations protect human health activities in various social relations. In order to prevent, control and eliminate the outbreak and prevalence of infectious diseases and safeguarding human health and public health, our country has carried out lots of legislative work on infectious diseases, and gradually improves the legal system of its control and prevention. After the SARS outbreak in2003, China revised "Law of the PRC on the Prevention and Treatment of Infectious Diseases" in2004, and introduced a number of supporting regulations, rules, to improve the legal system for the prevention and control of infectious diseases. However, some problems exposed in the practice process. This article analyzed in the legal system for the prevention and control of infectious diseases from the point of the health law and put forward the ways to solve and improve major existing problems through the comparison and logical analysis methods.The text is divided into three parts, China’s legal system for the prevention and control of infectious diseases, the lack of legal system for the prevention and control of infectious diseases, some suggestions in perfecting the legal system for the prevention and control of infectious diseases.The first part, overview laws and regulations related to the prevention and control of infectious diseases in China. Mainly elaborates the changes of the main legislation and the legal system on infectious diseases prevention and control and detailed introduce the existing laws and regulations on it.The second part focuses on the analysis of the deficiency of China’s current legal system on infectious diseases prevention and control. First mainly summary analysis problems in current laws, regulations and rules of the infectious disease, and then further detailed analysis of the deficiency of current infectious disease prevention law system from infectious diseases and emergency control, disinfecting products regulation, medical waste management, health supervision system and the provisions of the administrative legal responsibility.The third part, put forward the suggestions and measures based on the shortcomings mentioned above. Outlines the necessity to perfect the laws, regulations and rules and then further detailed the suggestions and measures from the shortcoming of current infectious disease prevention law system and puts forward the corresponding laws, regulations and rules and suggestions and measures. First outlines the necessity to perfect the laws, regulations and rules, to detail perfect aspects and further from epidemic control and emergency response system, disinfection product supervision system, medical waste management system, health supervision system and the provisions of the administrative legal responsibility.
