On The Legal Protection Of The Right Of Patients’ Privacy

In recent years, the invasion of the patients’privacy becomes a common phenomenon. The issue of the invasion of rights is pushed to a high note. Therefore, this essay attempts to discuss the related problems of the right of patients’privacy and analyzes how to deal with this issue in other countries and put forward some proposals in order to protect patients’privacy.As following, the essay is divided into five parts.The first part is on the right of privacy and the right of the patients’privacy. Through the definitions given by the scholars and experts domestically and abroad, the common characteristics of the right of privacy are abstracted from the definitions. Secondly, the definition of the right of the patients’privacy and its features are explained.The second part focuses on the invasion of the right of the patients’privacy. The expression of necessary parts of the invasion of the right takes the priority. Thus, the factors that lead to the invasion of the right of privacy can be clear to the readers in a general way. Next, the concrete situations of the invasion of rights of the patients’ privacy are illustrated in a specific way. Then, assume the responsibility of the patients’ right of privacy was infringed and under what circumstances can be exempted from liability.The third part is mainly about the necessity of protection of the right of patients’ privacy. The part is respectively from maintaining patients’rights and interests, advancing the rule of law and building a harmonious society three aspects to tell us the reason of protecting the patients’privacy, that is to say, it is the necessity of protection.The fourth part emphasizes present situation in protection of the right of patients’ privacy and drawbacks in China. The corresponding suggestions in better protection of the right of the patients’ privacy are gained.
