The Study Of Protection Of Patients’ Privacy Right

Abstract:The privacy right of patient indicate that when people have medical treatment service, they have the rights to ask medical institutions and their staff for making the patients’individual privacy safe, keeping them from the invasion of privacy. Basically, privacy right is a type of Personality right. Because of the particularity of medical industry, doctors have to touch patients’body, know their medical history or some private parts. It’s easy to violate on patients’privacy.The main reason of invasion of privacy in China is medical workers are effected by traditional medical system and lack of humanized medical service philosophy. Also have the reasons of poor management and facilities. Due to the closely connection between patients’privacy and medical treatment, legal protection of patients’privacy is different from the common one. In the case of an illegal observation of a woman’s abortion, teaching convention cannot be the argument of defense for the reason of without patient’s agreement.It’s necessary to balance the rights and interests between medical institutions and patients. Medical institutions should perfect their internal management, change teaching methods, show respect to patients. Meanwhile, the patients have to strengthen their awareness of protecting themselves.
