Legislation And Practice Of Community Correction

Community correction refers to a kind of criminal justice activity in which a non-custodial penalty in a community. It is different from custodial penalty and can be used to help decreasing criminal rate. Due to China community correction system implemented not long ago, there are a few researches on this issue. Author adopted a method which combined site investigation with theoretical analysis to conduct a systematic study on legislation and practice based on a case study of Fengcheng City.Author introduced concept and characters of community correction in the first part of this thesis in order to get a better understanding of the history and actual situation of community correction. Then we discussed the controversies between current laws through analyzing laws related to community correction. And in the third part author presented detailed first-hand information from site investigation of Fengcheng city and conclude the characters of Fengcheng community corrections : working patten networked, working mission targeted, management and education informationized, community services immobilized, penalty execution programmed, community correction humanized. And author also summarized some problems of Fengching city community correction pilot: awareness is insufficient, community correction work force is insufficient, Coordination mechanism is ineffectively and safeguard mechanism is defective. Based on the problems mentioned above and according to the realities of Fengcheng city, author suggested t,hat our community system should strengthen the legal system, relevant supportive system, coordination mechanism, social participation mechanism and informationzied supervision system. Hopefully this essay could provide some suggestions to legislation and practice of Community correction.
