As the reform of public institutions going on, with the perfection of reform of employment, all kinds of management personnel and professional and technical personnel flows frequent, this caused more and more controversy between the institutions and the personnel. The personnel dispute arbitration plays an increasingly important role as a personnel dispute settlement mechanism. Personnel dispute arbitration system which has Chinese characteristics is a relief system which protect and relief the legitimate rights of the institutions and individuals in the process of personnel management.The construction of Chinese Personnel dispute arbitration system has made great progress in recent years. On the basis of elaborate Personnel Dispute Arbitration basic theory, this article made a comparative analysis of specific systems and personnel dispute arbitration in civil and commercial arbitration, labor dispute arbitration institution to review the complaint system. However, in our judicial practice, our personnel dispute arbitration system still has some problems, for example, crisis of legitimacy of the personnel dispute arbitration system itself, issues of the applicable substantive law of personnel arbitration, the limited case range of the personnel dispute, not yet established of the type of system personnel arbitration award, the lack of neutrality personnel arbitration institutions, the improvement of the arbitrators service quality, etc. Correspond to the reality of limitations, this paper put forward a sound proposal which will further personnel dispute arbitration system. First, set up a legislation perfect of the personnel dispute arbitration, then a clear substantive law applicable to personnel dispute arbitration, to further expand the scope of the case of the personnel dispute arbitration, improve personnel arbitration award types, reform of the personnel dispute arbitration institutions, and improve personnel arbitration agency personnel professionalism. Standardized personnel dispute arbitration system is to safeguard the legitimate rights and interests of the parties, to ensure the further development of the personnel system reform, and is an important foundation for the promotion of social harmony and stability.
