Personnel Disputes Arbitration is a new style of personnel dispute resolution mechanism, and it creates a new method to resolve personnel dispute and keep harmonious social personnel relationship. But more and more problem appeared in the personnel dispute arbitration practice these years.This article focus on researching basic theory of Personnel Disputes Arbitration on the foundation of discussion of arbitration, personnel dispute, nature of Personnel Disputes Arbitration, and legal application problems.Combining the working practice, this article will point out the following problems of Personnel Disputes Arbitration:Firstly, the legislation level of Personnel Disputes Arbitration is too low. Secondly, the scope and prescription of personnel arbitration case are not clear, this will block the personnel dispute resolution. Thirdly, arbitrators system is incomplete. Fourth, the effection of personnel dispute mediation mechanism is limited and could. Fifth, the establishing process of arbitration institution is slow and block arbitration work development. One of the reasons is that the existence of personnel arbitration started relatively late and the theoretical system has not established totally. Another reason is that the we are in the critical period of personnel system reform, and more and more complex personnel disputes appear, all of these resulted in these institutional framework defects.Base on the analysis of above problems of Personnel Disputes Arbitration, this article tries to state the following five reforming measures:how to improve the legislation, make the arbitrator system better, strength the organization power, improve arbitration ability and establish arbitration institute.The reformation of Personnel Disputes Arbitration system and how to make it close to a perfection level is a complicated mission.through studies our country personnel disputes arbitration the problems in the work, from system structure and puts forward five aspects in the practical work of reform and perfect measures, push for a system of continuous improvement.
