The Marine Insurer’s Right On The Subject-matter Insured

This thesis mainly studies on the marine insurer’s right on the subject-matter insured after compensation based on Article 250 and 256 of Maritime Law of PRC combined with relevant provisions of MIA 1906, using the method of comparative analysis, and case analysis. Meanwhile the paper points out some unreasonable stipulations of Maritime Law of PRC and makes suggestions to the amendment hereofThis article is divided into five parts except for the preface and conclusion.The first part is the introduction of insurer’s right on the subject-matter insured after compensation including its development and legal basis. The author mainly concentrate on the nature of this right compared with other related concepts.The second part mainly discusses the specific application of marine insurer’s right on the subject-matter insured after compensation. As one key chapter, the author probes into the contents and characters of the topic in abandonment and total compensation hereof, and the question of marine insurer’s right on the subject-matter insured under partial loss is also discussed.The third part further introduces the contents and restrictions of marine insurer’s right on the subject-matter insured after compensation. Also as one key chapter, the author hereby mainly discusses the influence of under-insurance.The fourth part points out the exertion of marine insurer’s right on the subject-matter insured after compensation, together with conflicts with other related rights.In the last part, the author studies the stipulation of Maritime Law of PRC related to marine insurer’s right on the subject-matter insured after compensation and makes suggestions hereof.
