Predatory pricing is a typical behavior of “the abuse of market dominance”, which is an important subject of the anti-monopoly law. Most of the countries in the world have listed the behavior of Predatory pricing in their system of anti-monopoly law. Predatory pricing, means that the vendor who can dominate the relevant market sells their products with a below-cost price continuously, in order to push other competitors out of the market, and once monopolized the market, the perpetrator will damaging harmfully the market and simultaneously the interest of costumers while grabbing high profits.It is hard to regulate the behavior of predatory pricing, mainly due to the difficulty of the recognition. How to definite the elements of predatory pricing is now an important problem all over the world. With the analyzing of the pros and cons of several principals of the cost, this thesis primarily elaborates around the problem of the identification of the behavior of predatory pricing, and hereafter put forward the proposals in connection with the problems.This thesis is composed by five part:The first part is the summarize of the behavior of the predatory pricing, it introduces the meaning and the influence of predatory pricing and the difference between other similar concepts.Then, this paper analyzes the theories of several countries such as America and European Union, and tries to analyzing the standard of the cost.The third part tells the difficulties of the identification of the behavior of predatory pricing, including the new challenges brought by the internet and the Bilateral Market.In part four, combined with all the topics above, this thesis generalizes the regulations of China, and analyzes the shortcomings.The last part, facing the problems listed above, this thesis tries to explore a path of solution.
