Investigation Of Statutory Succession

Statutory succession disputes are frequent and the lives of the people level along with the country’s reform and opening up, economic activity increased, and gradually increased the types of disputes, prevention and reduction of legal inheritance disputes, need the comprehensive national and social aspects of measures. Therefore, only through political, economic, legal, social, family and other aspects of the efforts of the parties themselves, in order to achieve the prevention and reduction of legal inheritance disputes, the establishment of a harmonious family objective. This paper is a survey of legal inheritance disputes and report.Besides the first chapter is the introduction and a conclusion in the last chapter, composed of three parts.The second chapter is the part of basic theory about the legal successor, the concept and characteristics of clear statutory succession, testate succession and household division is associated with the meaning of the statutory succession, discriminate analysis, and then the law of Chinese and foreign relevant statutory succession, described and analyzed.The third chapter is the investigation and analysis of the legal inheritance cases in Yanji City People’s court. Findings from the survey, the statutory succession cases in Yanji City, there are more and more increasing trend, from the perspective of ethnic Han Chinese family inheritance disputes more than Korean family inheritance disputes, from the type ofheritage view the subject property between the parties is the main type of propertydisputes. In addition, between the old property disputes, property disputes between brothers and sisters of the proportion.The fourth chapter is the legal thinking for the legal inheritance case part. From the analysis of the case, a statutory succession and the laws and regulations of our countryare closely related. Revise and improve the law, to prevent and reduce the statutory succession dispute will play a decisive role.
