China’s Criminal Procedure Law revised in 2012 has been further developed, the exclusionary rule of illegally obtained evidence of progress is worthy of praise, but there is still a lot of need to revise and improve. Especially in the scope of application of the exclusion of illegal evidence rules, the provisions of this law the scope is very narrow, the content is too simple.South Korea and China in the Asian region, but the South Korean legal thought influence of Anglo American law system in the early, cognition and understanding of the law is relatively have a lot to learn from the part. So, the author wants to exclude illegal evidence in our country is part of the scope of application of the rules and find out the advantages and disadvantages of South Korea, in the study and comparison of the two rules, this paper puts forward some suggestions, hope to be able to improve the exclusionary rule in China and make a little contribution.This article includes five chapters. The first chapter is the introduction, the purpose, significance, status and methods of this paper introduced the research; second chapter describes the legislative status quo, the connotation of the exclusionary rule in China, the significance of the scope of application of the third chapter introduces the legislative status quo; illegal evidence exclusion rules, the connotation of South Korea the significance, scope of part; the fourth chapter is the most as the main content, for example, the provisions of the scope of special two; the fifth chapter is about the exclusionary rule of illegal evidence in our country the scope of the opinion; the sixth chapter is the summary of this thesis.
