| With the development of science and technology and the emergence of various forms of reproduction, online infringement of copyright become more and more rampant, the legitimate interests of the copyright owners is subjected to serious threat. Compared with the high cost of judicial protection, copyright owners prefer to protect their own copyright through technical protection measures. The most countries in the world and intellectual property organization bring copyright into related legal protection, but it will produce a new system conflict, it will be in conflict with the fair use and exhaustion of rights principle, moreover, it will break the delicate balance between general public and copyright owner under the traditional copyright system. Therefore, many countries not only protect the legitimate interests of the copyright owner, but also restrict the right of copyright owner through legislation.The technical protection measures of copyright is a double-edged sword, we cannot allow the copyright owner abuse the right to violate the public interest and indulge piracy and illegal copies in the digital network era. We should strike a balance among copyright owner, network service providers and general public through the protection and regulation. This paper aims to clarify the connotation and nature of technical protection basing on the analysis of its definition, nature, classification, component factor and legal interests, then analyse the necessity of protection and regulation, ensuring the value and significance of the research. The following content analyses deficiencies in legislation of copyright protection and state that we should take the legislation experience and idea of developed countries and regions as lessons,which should be combined with the actual situation and the judicial practice of our country, and put forward corresponding suggestions to improve Chinese technological measures of copyright protection system. |
