| Technical measures are the technical measures adopted by copyright owners to protect works or other objects in the digital age.Current Technical Measures Fail to intelligently identify whether the user is using the work properly and fully prevent all unauthorized access to protected works.Therefore,the imbalance of interests caused by the protection of copyright technology is inevitable.In order to deal with the imbalance of interests caused by the protection of copyright technical measures,the third amendment of our country’s Copyright Law of South Korea stipulates the exception of prohibition of circumvention,but there are some problems such as narrow scope and incomplete content.In order to promote the dissemination of knowledge,cultural prosperity and social progress,it is necessary to perfect the protection system of China’s copyright technology measures.The relevant legislative model of Singapore could be appropriately used for reference by listing the list of permitted technical measures to be circumvented and periodically reviewing the list of technical measures to adapt to technological developments.The prohibition of circumvention of technical measures is accompanied by appropriate restrictions on the conditions of the prohibition and the addition of exceptions to guarantee that the user’s space of rights is not squeezed. |
