The Application Of Law For Fabricating And Intentionally Spreading False Terrorist Information Crime

The crime of fabricating, deliberately spreading false terrorist information against the public order, therefore, the charge has greater social harmfulness than the others. In recent years, this kind of crime shows a characteristic:It is gradually increased for aviation aircraft. The aviation industry has its own characteristic that is different from land and sea, result that crime aim at the aviation industry has greater social harmfulness. So, it is very important to against this type of crime and safeguard stable production and living order.The development time of this crime in our country is shorter, although,2013 September 16, in the 1591 meeting, judicial committee of The Supreme People’s Court has passed the "The Supreme People’s Court on the trial fabricated, deliberately spreading false terrorist information interpretation of the law applicable in criminal cases Issues", but in the judicial practice, often appear some new situations and new problems, cause imbalance, not uniform in judicial application. Therefore, this article based on the method of case analysis, carried on analysis to the practice in controversial views and the difficulties, and accordingly put forward countermeasures, contribute to a force for China’s legal system.This paper, through comparative study, historical analysis, document analysis and other research methods for fabricating, deliberately spreading false information about the crime of terror launched applicable law discussed. The first chapter introduce the research purpose, significance and research status of the crime. The second chapter Shanghai "4,27" fabricated, deliberately spreading false terrorist information case, detail the definition and characteristics of this crime, constitute a crime. The third chapter analyze the law applicable to the crime in the presence of problems, including the provisions of the criminal object vague, for "seriously disrupted social order," the provisions of questionable circumstances, people fabricate, deliberately spreading false information about a terrorist crime awareness inadequate. Chapter IV of these issues put forward their own little opinion. The fifth chapter, the author summarize the contents of the previous four chapters and present how to apply fabricate deliberately spreading false terrorist information crime in practice.
