Research On The Crime Of Fabricating And Deliberately Disseminating False Information

With the increasing popularity of the Internet,false information is also spread throughout the information network,which not only infringes on the legitimate rights and interests of citizens,but also undermines the social and public order.In August 2015,the Standing Committee of the National People's Congress adopted the proposal of the Amendment to the Criminal Law(9).It added a new criminal offence of "fabricating and intentionally spreading false dangerous situations,epidemics,disasters and police situations on the information network or other media" as "the crime of fabricating and intentionally disseminating false information".According to the Criminal Law Amendment(9),this article gives a systematic overview of the crime.Combining with the relevant judicial practice cases,this paper compares this crime with that of the crime of provoking trouble and of fabricating and intentionally spreading false terrorist information,so as to make an in-depth analysis of the constitutive elements of the crime of fabricating and intentionally spreading false information.Finally,the specific application problems of fabricating and disseminating false information and their solutions are put forward.I hope that this article will be helpful to the related judicial practice in the future.
