The Study On The Self-declaration System Of Enterprise Product Standards In China

The Self-declaration of enterprise product standards is a conformity declaration and it refers that enterprises to make commitment declaration about the compliance between the enterprise product standards and products. The Government filing system for enterprise product standards was formally established by the "Standardization Law" of our country, it has the characteristics of planned economy. With the Government filing system for enterprise product standards, enterprise, who shall be the main player of Standardization, can’t have its main player position been confirmed. Enterprise standardized activity that shall belong to enterprise micro activity faces the administrative intervention from governments when our governments use the Government filing system for enterprise product standards. Following the completing of Chinese market economy system, disadvantages and drawback of the Government filing system for enterprise product standards have appeared, innovation is imperative. Now, the "Standardization Law" of our country is being revised. Through it our government want to use the Self-declaration system of Enterprise product standards and the rules of the Self-declaration system will be set base on the main position of the enterprises. The rules of the Self-declaration system will give full play to the functions of autonomous management and market supervision and can allocate the legal responsibility reasonably. The Self-declaration system of Enterprise product standards has more advantages than the Government filing system for enterprise product standards on activating enterprise standardization activity, promoting enterprise product development, improving enterprise product standards level and product quality, increasing the competitiveness of enterprise in the market. Based on the protection of public interests, the products need to be supervised and managed by the government, which is related to the fields of health, security, hygienism and environmental protection. And the Government filing system for enterprise product standards will still be the management system of these special enterprise product standards should be used for the record system. With the Self-declaration system of Enterprise product standards, enterprises are entitled to choose to make self-declaration or not. However, only qualified body can make self-declaration. When making specific self declaration, enterprises are entitled to choose different declaration platform, and have the right to choose to publish full text of the standards and provide attached supporting information or not. Certainly, when enjoying these rights, enterprises shall take certain responsibilities to ensure that the self-declaration can deliver sufficient information, make sure that information published on the self-declaration is true, legal and maintain continuous effectiveness of the self-declaration. And enterprises are not entitled to change, suspend or cancel the self-declaration unless the declaration is of no effectiveness. These are also the requirements from ISO/IEC 17050:2004. When products are not in line with standards, of fake marketing, default or cause damage to body and wealth of others, related enterprise shall take responsibility and the self-declaration will be used as the judgment basis.
