The developed countries proposed carbon leakage problem firstly, it means some countries having obligations to comply with mandatory emission reduction take mitigation measures, leading carbon emissions of those countries out of binding obligation rise, it originated in the Kyoto Protocol of "Common but Different Responsibilities" principle, leading disequilibrium in emissions reduction obligations, while the developed countries and developing countries have been in a stalemate situation about the leakage problem. Currently, when it comes to the carbon leakage problem, having the world’s major countries or regions of carbon emissions trading system, the European Union and the United States take the measures such as the free quota, unilateral regulation measures, such as carbon tariffs, while to the implemental effect, having no fundamental influence on the occurrence of leakage. Based on the analysis of the pros and cons of the unilateral legal measures, combining the analysis of the related data, expounds and analyzes the gaps in multilateral legal mechanism and adverse effects from the angle of multilateral legal mechanism, it comes to a conclusion that only establish a bottom-up global carbon trading market including all the countries in the world, will the problem of the global carbon leakage be fundamentally solved. And give some advise on the measures our country do well in risk control in foreign trade of carbon leakage problems.The thesis consists of three parts of preface, text, conclusion.The text is divided into four chapters, the main contents of each part are as follows.Chapter 1 introduce the concept of carbon leakage, background, influencing factors, channels and simple carbon leakage rate, then analyzes the influence of leakage system in developed countries and developing countries as well as the global environment.Chapter 2 introduces the measures that the European Union and the United States take to deal with carbon leakage, and the progress in the implementation and the effect.Chapter 3 discusses the legal regulation on carbon leakage problem from the perspective of the environmental regulation system and the trade system respectively, and put forward some concrete suggestions to establish a global carbon market.Chapter 4 analyzes the measures our country should take to deal with carbon leakage problem in the economic and trade exchanges, and give suggestions on carbon leakage risk control in the future our country enterprise comply with overseas investment, m&a, building factories and other economic activities, and insist on the principle position and give positive reaction to trade restrictions while establishing a global carbon trading market.
