With the wide application of Internet technology and upgrade, Internet advertising has developed rapidly, not only in the form of web ads, search engine ads, software ads, E-mail ads, online games ads, but also performs some distinct Internet advertising characteristics from the traditional media like low cost, immediacy and participatory, concealment, mandatory and verticality. However, the legal system of regulate Internet advertising behaves disordered and specific provision lagging, most regulations are just inject network to be a regulatory object based on traditional advertising regulation and rarely formulate specific regulations and methods according to the characteristics of the Internet advertising. ’Advertisement law" in China is the fundamental solution of the current regulation of Internet advertising, but there is no clear definition of Internet advertising and no specific set the network as; kind of advertising media, which makes the "advertisement law" uncertain when it is used for Internet advertising and obstructs for regulate Internet advertising. The other two regulation of Internet advertising state law "Anti-unfair competition law" and "Consumer rights and interests protection law" do not specify Internet advertising proclaimed in writing, brings some difficulties in legal regulation of Internet advertising to the relevant authorities.In this article, three state laws, a "advertisement law" revised draft, a administrative rules and regulations of the state council,15 department regulations and documents of the state council, two local rules and regulations and other normative documents of current Internet advertising regulatory system are investigated. By systematically classify, analyzes its regulation subject and regulation object, the problems and deficiencies existing in the current network advertisement regulation law in our country are discussed.Finally, legislative proposals of the related regulation of Internet advertising are put forward in two parts. In the first part, the author presents adjust and perfect the current revision of the "advertisement law" in order to improve the system of Internet advertising regulatory advice, and specify the when revise and perfect "advertisement law", first, add to the provisions of the regulatory body should not only clear network advertising regulatory body, but also for the network advertising regulatory agencies o set up dedicated Internet advertising regulatory agencies or professionals; Second, we should clear personal and regulation for the network advertisement publishers; Third, personalized legislation should be based on the characteristics of Internet advertising, including in the form of legal regulation of online advertising to intercept problems and strengthen the information disclosure system. The second part, the luthor thinks that shall be issued from the specification authority, keep consistent between the laws, regulations and rules, and reduce duplication of the provisions of the similarity is very high, can save resources for legislation three aspects of the legal system, perfect regulation of online advertising.
