Since Administrative Proceedings was founded, in China it has been widely used and confirmed in the practice of administrative litigation, to a certain extent, reflecting it as an independent form and value of litigation, and makes up the shortfall of administrative litigation system which lack of other types of litigation, it meets the needs of judicial practice in very large extent, so that it can protect the administrative relative person’s legitimate rights and interests. With the development of the society, academics found a lot of problems in regulation of administrative legislation of Administrative Proceedings during the further study of basic theory of administrative procedure law, and enrich the practical experience of administrative litigation, which inevitably leads to chaos in specific application, and thus affect the value of system implementation. Therefore, the basic purpose of this study is sorting out the basic theory of Administrative Proceedings, and further perfecting its value system on the basis of improving the value of Administrative Proceedings. This study consists of four parts:The first part is to discuss the basic theory of Administrative Proceedings. First to discuss is how to make a definition of Administrative Proceedings. There existing many different theories about the definition of Administrative Proceedings in administrative procedure law circle, the authors synthesized the various views and proceed to discuss the definition of Administrative Proceedings. Second to discuss is what the features of Administrative Proceedings is. Administrative proceedings was declaratory in purpose, complementary on the status, relief in nature, and non-executive on the result. Third to discuss is what types and effectiveness administrative proceedings have. Legally binding of administrative proceedings include: the effect of elimination of administrative act’s legally binding, the effect which can decide the liability of administrative compensation and produce legal effects. Finally, it discuss what is the value of administrative proceedings. Author will illustrate the value of administrative proceedings based on following four aspects: value of oversight of administrative proceedings, regulative value of administrative proceedings, security value of administrative proceedings, and offset value of administrative proceedings.The second part is a comparative study of Administrative Proceedings on external field. Research focused on common law countries like UK, US and Japan, as well as civil law counties like Germany and Taiwan. By comparing the content of their applicable conditions, scope, procedures, etc.it analyzes the different characteristics of different countries and regions, to find the laws of common development of Administrative Proceedings, so that Administrative Proceedings can make a better development.The third part is the analysis of the current situation of China’s Administrative Proceedings. Author will start with legislative evolution of Administrative Proceedings, and then proceed with a detailed interpretation of the content of legislation, so that it can identify Legislative Defects of the Administrative Proceedings, and conducted in-depth discussion and analysis of causes of defects. This is to reflect the current situation of China’s Administrative Proceedings, through further practice, and supplemented cases and data analysis,The fourth part is to attempt to put forward some ideas to perfect China’s Administrative Proceedings. The first is to perfect legislative regulation of use conditions, the second is to make sure a proper and orderly proceedings, and the third is to be perfect on the referee form.
