Licensing System Present Situation And Perfection Of The Marine Environmental Protection

In environmental law of many countries in the world, license is a main institution in preventing environmental risks. Because license can bring all constructions and pollutions into united management of a government and control them strictly, it is used widely in modern environmental laws.But in practice, the system has not been effectively implemented, naturally does not really produce the desired effect. In China, the environmental licensing system exists positioning system is unknown, legislation behind the practice, the project license system incomplete legislation, lack of operational law, not with the total control system combined with other issues, these problems have restricted the licensing system to play environmental effects the aim, it is difficult to form a unified force. From a subjective point of view, under the guidance of the scientific concept of development, construction, energy saving, environment-friendly society requires a license system, from the objective side, due to the non-renewable natural resources, increasing environmental pollution status quo as well as from international and domestic protection of environmental pressures, forces us to pay attention to environmental licensing.In recent years, environmental pollution is increasing, the living environment of the residents threatened, environmental planning and environmental law enforcement issues become more widespread public attention. Environmental issues and citizen personal health, quality of life and property safety and other closely, especially as "the cradle of human life," the marine environment, to the country’s economic development and people’s lives has brought great treasure. Marine environment contains a very rich resource reserves, shortening environmental damage in recent years, terrestrial ecosystems and resources, more and more people began to turn to want to take advantage of this treasure trove of marine development. However, the development and use of such excesses have far exceeded the carrying capacity of the marine environment. Limited natural resources and the marine environment to accommodate the degree will one day be depleted by human behavior. So must pay attention to an important position in the marine licensing system protection.This paper is divided into four chapters of this system are discussed.
